Terms of Service

1. Acceptance of terms

By joining the waitlist, creating an account, or using fluensee.io and the Fluensee platform (together, "Fluensee"), you agree to these Terms and our Privacy Policy. If you don't agree, please don't use Fluensee.

2. What Fluensee is

Fluensee is a marketplace where brands post collaboration projects and creators apply to them — trading content for experiences, products, services, or payment. Fluensee is a venue: we are not a party to any collaboration, we don't employ creators, and we don't guarantee that any project will be completed, any content will perform, or any collaboration will meet expectations. Fluensee is currently in beta and features may change.

3. Waitlist & founding status

Joining the waitlist doesn't guarantee access; we onboard in waves. Founding-member benefits described at signup are subscription-level benefits and remain as stated. Optional paid items (such as verification badges, featured placement, and boosts) are separate and paid by all users, including founding members.

4. Eligibility & accounts

You must be at least 18 and provide accurate information. One account per person or business; you're responsible for activity on your account and for keeping your credentials secure. Impersonating another person or brand is prohibited — we may require verification of social accounts or business identity.

5. Collaborations & trades

Each project listing defines the offer (for example a hosted meal, stay, product, or payment) and the deliverables expected in return. When a brand accepts a creator, the resulting agreement is directly between the brand and the creator; Fluensee provides the tools (listings, messaging, deliverable review, records) but is not a party to it.

6. Your content & intellectual property

You keep ownership of the content you create and upload, including your portfolio. You grant Fluensee a non-exclusive license to host, display, and process your content in order to operate and promote the platform. Rights to project deliverables transfer between creator and brand according to the project's stated terms. The Fluensee name, design, and software are our property.

7. Disclosure & compliance

Creators must clearly disclose material connections in published content (for example #ad or #gifted) as required by the FTC and equivalent regulators. Both brands and creators are responsible for complying with the laws and platform rules that apply to their content and business.

8. Conduct & reviews

No spam, harassment, scraping, or attempts to circumvent Fluensee's systems or fees. Reviews and ratings must reflect genuine experiences — offering or demanding ratings, retaliatory reviews, and manipulation are prohibited. We may moderate content and suspend or remove accounts that violate these Terms.

9. Fees

Fluensee is free to use during beta. Paid subscription tiers, add-ons, and à-la-carte items will be introduced with clear notice and pricing before you're charged for anything. Founding-member benefits are honored as described at signup.

10. No warranties

Fluensee is provided "as is" and "as available", without warranties of any kind, express or implied. We don't warrant uninterrupted or error-free operation, or the conduct, content, or reliability of any user.

11. Limitation of liability

To the maximum extent permitted by law, Fluensee and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Fluensee or any collaboration formed through it. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim.

12. Termination

You may stop using Fluensee and request account deletion at any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive (including content licenses for completed collaborations, disclaimers, and liability limits) survive termination.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Los Angeles County, California.

14. Changes to these terms

We may update these Terms as Fluensee develops. For material changes we'll give notice by email or in-product before they take effect. Continued use after changes take effect constitutes acceptance.
